Terms of Service

1. Who we are

"DefShield VPN" is a subscription VPN service offered through the website defshieldvpn.app (the "Website"). The Website and the service are operated by the DefShield VPN team ("DefShield VPN", "we", "us", "our").

These Terms are an agreement between you and DefShield VPN. We are the seller of all subscriptions purchased through the Website and are responsible for billing, subscription administration, customer support, cancellations, refunds and payment disputes.

2. The Service

The "Service" consists of the Website, your customer account and dashboard, and encrypted VPN access to our server locations using the WireGuard protocol.

We do not distribute a proprietary application. The Service is used through the official WireGuard client software published by the WireGuard project, into which you import the configuration files we provide. The client is third-party software governed by its own licence.

Each subscription allows up to 5 simultaneous VPN connections. Configuration files may be installed on any number of your own devices; the limit applies to concurrent connections.

3. Subscriptions and pricing

Before completing a purchase, you will be shown:

• the amount charged immediately;
• the duration of the initial billing period;
• any introductory price;
• the regular renewal price;
• the renewal frequency;
• the automatic-renewal terms;
• the available cancellation method.

Prices are stated in US dollars. Applicable taxes may be added at checkout where required by law. Payments are processed by a third-party payment processor acting on our behalf; the processor may collect and process payment details under its own privacy policy. We never receive or store your full card number.

4. Digital delivery and access

Access begins after successful payment confirmation. Within a few minutes of payment you will receive an e-mail containing your account details and a link to your dashboard, where WireGuard configuration files for every server location can be downloaded. Delivery is entirely digital; nothing is shipped.

If you do not receive access within one hour of a successful payment, contact [email protected] and we will investigate.

5. Automatic renewal and cancellation

Subscriptions renew automatically at the billing interval and renewal price shown before purchase, unless cancelled before the next renewal date.

You can cancel at any time by emailing [email protected] from the address associated with your subscription. We confirm cancellations within one business day. Cancellation prevents future renewal charges. Unless otherwise stated or required by law, access continues until the end of the paid billing period, after which your configuration files stop working.

6. Refunds

Purchases are governed by the Refund & Cancellation Policy published on the Website. Where the 30-day money-back guarantee applies, a customer who submits a valid request within 30 days of the initial purchase will receive a refund of all subscription charges made during that initial 30-day period.

7. Eligibility

You may use the Service only if you are at least 18 years old, or have reached the age of legal majority in your jurisdiction, or use the Service with the consent and supervision of a parent or legal guardian. The Service is not available to persons under 13 under any circumstances, or to anyone whose account we previously terminated for violating these Terms.

8. Your account and configuration files

You are responsible for keeping your account credentials and configuration files confidential and for all activity that occurs under your account. Configuration files contain private keys that identify your subscription; do not publish or share them. Notify us immediately at [email protected] if you suspect unauthorised use, and we will issue new keys.

Your subscription is for your personal use on your own devices; accounts and configuration files may not be shared, resold or transferred.

9. Acceptable use

You agree not to use the Service to:

• violate any applicable law or regulation, or infringe the rights of others;
• send spam or other unsolicited communications;
• distribute malware, or attempt to gain unauthorised access to systems, networks or data;
• engage in fraud, harassment, or the distribution of illegal content of any kind;
• interfere with, probe, scan or disrupt the Service or its infrastructure;
• resell or commercially redistribute the Service without our written permission.

We may suspend or terminate accounts that violate this section, without refund of the current billing period.

10. Licence to use the Service

Subject to these Terms and an active subscription, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use your account, configuration files and our VPN infrastructure on devices that you own or control.

No ownership rights in the Website, VPN infrastructure, configuration files, trademarks or other intellectual property are transferred to you.

11. Intellectual property

The Website, the DefShield VPN name and logo, the subscription system and all related Service components are owned by DefShield VPN or its licensors. You may not copy, modify, reverse-engineer or create derivative works of the Service except where the law expressly permits.

WireGuard® is a registered trademark of Jason A. Donenfeld. DefShield VPN is not affiliated with or endorsed by the WireGuard project.

12. Service availability

We work to keep the Service available at all times, but actual speeds, server availability and coverage may vary and depend on the internet, third-party infrastructure and factors outside our control. Individual server locations may be added, changed or retired. The Service may be briefly unavailable during maintenance, updates or due to events beyond our reasonable control (force majeure).

13. Privacy

Our Privacy Policy explains what data is collected, how it is used and what we never collect, and forms part of these Terms.

14. Third-party software and services

The Service relies on third-party software (the WireGuard client) and third-party services (such as payment processors and hosting providers). Those are governed by their own terms and privacy policies; we are not responsible for them.

15. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING YOUR STATUTORY RIGHTS AS A CONSUMER.

17. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination (including sections 11, 15, 16 and 19) survive.

18. Changes to these Terms

We may update these Terms from time to time. The current version is always available on this page with its effective date. For material changes we will notify you by e-mail before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

19. Governing law and disputes

These Terms are governed by the laws of Poland, without prejudice to any mandatory consumer-protection rules of your country of residence. Consumers in the European Union may also use the European Commission's online dispute resolution platform.
